Purchase, creation and care terms Version: wsh-contract@2026-10-07.5 en-gb / en Standard packages are contracted online — there is no separate document to sign. Your contract comprises the order summary, this version of the terms, the selected scope and the data-processing annex. While payment is unavailable, reviewing the selection and ticking boxes creates neither an order nor a contract. No individual quotation is required. 1. Parties and business purchase The provider is INMAR d.o.o., Gardinovec 24, 40319 Belica, Croatia, MBS 070096926, OIB 33281217245, info@inmar.hr. WebStartHub is the service name. The buyer is the business identified in the order summary; its authorised representative accepts the contract. The offer is not for private consumer purchases. Unclear business purpose or authority requires review before purchase; a B2B label or checkbox does not remove rights of someone who is legally a consumer. A checkbox does not turn an actual consumer into a business buyer; the actual purpose of the transaction is decisive. A private or unclear purpose cannot proceed through this B2B order without appropriate verification. 2. Online conclusion and contract copy No separate signature on a quotation, contract or data-processing annex is required for a standard package. Before final confirmation, the buyer can review and correct their details, package and payment model and save this version. Final confirmation of the paid order in Stripe is the electronic acceptance of the summary, terms, scope and annex. The contract is concluded when INMAR receives that acceptance; successful first payment is a condition for starting the service. A review, a checkbox on the review page, an opened or abandoned Stripe session and the return URL do not create a contract. The system acknowledges receipt and retains the time, buyer, language, exact content and version, and association with the verified Stripe session. Confirmation with the complete accepted copy is sent by email, not merely a link to changing terms. Orders are not currently accepted because payment is disabled. In this sales flow, definitive contract conclusion is conditional on confirmed first payment. An automatic acknowledgement of an enquiry or order alone is not acceptance of an offer. Contract storage, access and languages The terms are available in Croatian, German and English, with regional versions for Croatia, Austria, Germany, Switzerland and the UK. The exact displayed language version is accepted and stored. Before the final order you can review and correct your selection and download terms that can be saved and reproduced. For each order, the complete accepted copy with its summary, version, statement texts and acceptance evidence is stored privately; it is not public or accessible to other customers. After a confirmed paid order we email confirmation and the complete copy; you can request your copy again at support@webstarthub.com. We do not promise a purchasing customer portal that has not yet opened. INMAR has not identified a particular binding e-commerce code of conduct to which it subscribes. 3. Included and excluded services The selected package and payment model in the summary are binding, subject to the limits in the price list below. Each standard package covers one location, market and language, an individually designed website within the package, text based on truthful client information, hosting, technical care, included small changes, Search Console setup and an initial Google Business Profile check with approval and required access. Start covers one content page and basic contact; Business up to five content pages and basic contact. Flow additionally covers one standardised sector workflow, two named private-portal users, up to three photos per enquiry, statuses, notes, values, reply, owner reminder and one follow-up message only with required consent. A native shop or booking calendar, POS/ERP, bespoke integrations, multiple workflows, locations or languages, SMS/WhatsApp, autonomously replying chatbot, ads and separately developed portal are excluded. Qualification, demonstration and content approval are not a new contract signature. Extensions require further express online acceptance before work or billing and are not added silently. Creation includes one consolidated correction. Hosting includes TLS, backups and monitoring; technical SEO basics, monthly Care status and a quarterly review of available aggregated action attempts only with analytics consent are included. A click, delivered enquiry and confirmed job are different events. Review and communication can be in writing, without a mandatory call. 4. Price, billing and minimum commitment Prices below and in the selected summary are in EUR and are final amounts for our service without an additional VAT charge. The no-setup model requires twelve monthly payments at the initial price; the first is due on purchase and others monthly. After the first twelve required monthly payments, the lower monthly rate applies. With setup, the first payment includes creation and the first monthly fee; care is then billed monthly. The next billing date and subscription start appear in the Stripe confirmation. Fees are not conditional on enquiry or job volume. Swiss and UK billing remains in EUR; the bank may apply conversion or its own fees. Domain registration, external-provider subscriptions and additional work are not automatically included unless specified in the summary. A partner code changes terms or price only where a separately approved offer is expressly displayed and accepted. 5. Creation, cooperation and launch After the first payment, onboarding follows: the client supplies accurate business details, materials they have rights to use and required access through official invitations. Passwords are not sent by email. The client confirms domain, contacts, services and facts, and is responsible for the lawfulness of their business and final business claims. We confirm the launch plan after receiving necessary materials and access, without promising a deadline before checking them. The client reviews the preview and explicitly approves publication, for example by email or in the portal, without signing a new contract. Silence is not approval. Missing materials or access may delay delivery; we inform the client. Requirements outside the standard scope are not charged additionally without express agreement. 6. Care, changes and actual outcomes Care covers technical availability, agreed main links, a form-check signal without a real customer enquiry and status reporting. Faults in our implementation within scope are handled as technical care, separately from the included 15/30/60 minutes of requested content changes for Start/Business/Flow. There is no 24/7 SLA, guaranteed repair deadline, delivery of every enquiry, sales outcome or Google position. The owner answers enquiries, estimates prices and confirms jobs; the system does not replace those actions. For detected issues we report the status and next step without waiting for the monthly report. This does not exclude our statutory responsibility for our service. 7. Cancellation, non-payment and complaints Send cancellation to info@inmar.hr with order identity and requested end date; we acknowledge receipt and confirm the actual date. With no setup fee, cancellation does not remove the first twelve payment obligations; ordinary termination is possible after them on 30 days’ notice. The setup model’s monthly service can be cancelled on 30 days’ notice. Service continues monthly until cancelled, without a new annual commitment after the first twelve payments. Closing a card or a failed payment is not cancellation. Before suspension for non-payment we notify the client and allow a reasonable opportunity to remedy it; urgent security or statutory measures are excepted. Send complaints, defect-remedy or refund requests with a description to the same contact. Statutory rights for our breach remain intact; lack of leads alone is not proof of non-delivery. Existing clients’ previously agreed rights and obligations remain unchanged. 8. Ownership, export and exit The domain, approved content, brand, data and leads remain client-owned. After due obligations are met, the buyer receives the current static export and their media on exit; Flow also provides active enquiries as CSV. Personal data can be exported or deleted using permitted functions; data-subject rights are not conditional on paying invoices. The Flow portal, reusable components, templates and automation are not transferred as property. Additional migration is agreed before additional work. Buyers can request their accepted contract version; a new public version does not change it. 9. External booking and partners External booking setup is EUR 290 once and covers one provider, location and language, up to 15 services and three staff members, plus connection to the website and Google Business Profile where supported. Provider subscription, SMS, fiscalisation, large migration and custom API work are excluded. This add-on is not automatically part of the standard order; it requires an explicitly displayed and accepted additional summary. A partner code does not change package, price or scope. Any partner commission is calculated only from successfully collected payments and corrected for refunds or disputes. Partners receive no form data or portal access. 10. Buyer data and separate consent Buyer contact and business information and order/payment evidence are processed for contracting and performance, statutory duties and proof of acceptance as described in the privacy notice. Contract acceptance is not consent for marketing, analytics or messages to end customers. Required consents are collected separately and are not preselected. Card numbers and CVC are not stored by WebStartHub. Stripe processes payments under its published terms and privacy notice. Annex A. Processing: subject, duration and roles This annex forms part of the same online contract in written electronic form where INMAR processes personal data for the buyer. The buyer is controller for their visitors, enquirers, portal users and contact persons; INMAR is processor for hosting, transmission and storage of permitted enquiries, messages, portal, care, export and deletion within selected scope. The subject and purpose are those services, not INMAR’s own marketing. Data includes names, contact details, enquiry descriptions and sector details, up to three permitted photos for Flow, statuses, notes, values, consents and technical security data. Health data, other special categories, criminal data, vehicle documents, VINs or registration numbers are not requested. Processing lasts during the service and necessary exit handling. Our own buyer relationship and accounting records fall under the privacy notice, not this processor role. Annex B. Instructions, confidentiality and security The buyer determines lawful purpose, notices and documented instructions, including this accepted scope and permitted later instructions through the official channel. INMAR processes only on documented instructions, including international transfers, except where applicable law requires otherwise; it then informs the buyer in advance unless prohibited by law. Authorised persons are bound by confidentiality. Risk-appropriate Article 32 GDPR measures include restricted access and tenant separation, protected transmission, private photo storage, single-use sign-in, logging security-relevant actions, file-type and size controls and maintenance, recovery and deletion procedures. This is not a certification claim or guarantee of absolute security. If INMAR considers an instruction to infringe data-protection law, it promptly informs the buyer and does not carry out an unlawful instruction. Where Swiss law applies, Article 9 of the Swiss DSG also applies: processing may cover only what the controller is permitted to do, confidentiality obligations must not be breached, data security must be ensured and further outsourcing requires prior approval. This electronic annex does not exclude applicable mandatory Swiss rules. Annex C. Subprocessors and international transfers The buyer gives general authorisation only for actual subprocessors listed before acceptance and saved with their order. The list must identify the legal entity, function, processing locations and applicable transfer mechanism; online contracts are not currently concluded until that list and payment are verified. VPS hosting and transactional email (Resend if used) require verification of actual agreements and locations; a tool name alone is not evidence. Stripe is not automatically a subprocessor for Flow leads: its payment role is assessed separately. INMAR gives at least 30 days’ advance notice of additions or replacements and an opportunity to object. A reasoned objection is resolved before the change through safeguards, an alternative or termination of affected processing. Subprocessors are bound to equivalent data-protection obligations; INMAR remains responsible for their processing obligations. Transfers outside the EEA, UK or Switzerland occur only under applicable requirements, including adequacy or contractual safeguards and necessary assessments. Acceptance of these terms does not waive those requirements. The complete chain register must include each subprocessor’s legal name, address, contact, role and which party commissioned the further processing. It is available to the customer before final acceptance; a public internet database is not required. Annex D. Rights, incidents, oversight and deletion Taking account of processing nature and available information, INMAR assists through appropriate technical and organisational measures with data-subject requests and Articles 32–36 GDPR duties, including security, breach notification, impact assessments and prior consultation. It reports personal-data breaches to the buyer without undue delay upon awareness, with available information and later updates, rather than waiting for an arbitrary contractual deadline. It makes necessary information, inspections and audits by the buyer or authorised auditor available, with reasonable coordination and protection of others’ data. Start/Business basic enquiries are not retained by WebStartHub after successful delivery. Flow photos are deleted within 90 days; enquiries by default 24 months after last activity or earlier on instruction/shorter settings. On termination, personal data is returned or deleted at the buyer’s choice and copies deleted, except legally required retention; any backups are restricted and removed in a verified cycle without reuse. Actual backup periods must be documented before activation. These duties are not removed by content-change minute limits or unpaid invoices. 11. Versions, languages and applicable rules The version and language identified in the summary are accepted; Croatian, German and English are offered according to the selected market. Publishing new terms does not retroactively change existing orders. Material changes to scope, price or obligations require new express acceptance before taking effect; the originally accepted text and mandatory protections remain available in disputes. Croatian law applies subject to mandatory rules applicable in the circumstances; statutory jurisdiction and consumer rights where the actual purchase is consumer-facing are not excluded.
